    You can legally do anything you want. It’s your car. But remember, if you are claiming that the car was totalled in the accident, your ability to sell it proves that it wasn’t totalled.

    The measure of the damages in a suit like this is the difference in value between what the car was worth before the accident and what is is worth after the accident. You cannot collect twice for the same car, once from the other driver’s insurance and once on a sale to a third party.

    The judgement is already rendered and should not keep you from selling the car. The sale will not change the amount set by the court.

    Depends upon where you live. Best bet is to call your local LEMON LAW coordinator and ask the rules on that.

    Yes, it is legal to sell your car. HOWEVER, you MUST disclose the fact that the car has been in an accident, what the extent of the damages was, and how it was repaired. If you do not disclose this information, you will be sued for non-disclosure. I would suggest telling potential buyers it was in an accident and telling them to use.
